TOURNAMENT - TERMS OF USE

The Company Galvin Tecnologica SL (from now on, "Duel" or "we"), based in Avda. de Madrid, 197 - 36214, Vigo , Spain; uses the Duel software package (a platform application on the Internet that can be accessed at the address https://duel.plus, from now on, the 'Web') which allows users to create, organize, manage and share tournaments or participate in tournaments (from now on, 'Services').

1. Acceptance and modifications of the General Conditions of Use

THE PURPOSE OF THESE TERMS OF USE (from now on, "Terms"), WHICH ARE SUBJECT TO SPANISH LAW, IS TO REGULATE THE USE OF THE SITE AND ASSOCIATED SERVICES. YOUR ACCESS AND USE OF THE SITE AND THE SERVICES, WHETHER YOU ARE ACTING AS AN INDIVIDUAL OR ON BEHALF OF A COMPANY, CONSTITUTES YOUR EXPRESS AND COMPLETE ACCEPTANCE OF THE TERMS, AND YOU REPRESENT THAT YOU HAVE ALL THE RIGHTS, AUTHORIZATION AND POWERS NECESSARY TO ACCEPT THE TERMS. THE TERMS MAY BE MODIFIED AT ANY TIME WITHOUT PRIOR NOTICE OR ACKNOWLEDGMENT, AND THEREFORE IT IS YOUR RESPONSIBILITY TO CHECK THEM PERIODICALLY. IF YOU DO NOT ACCEPT THE MODIFICATIONS, YOU SHOULD STOP USING THE SERVICE IMMEDIATELY. YOU MAY NOT ACCESS OR USE THE SERVICE IF YOU ARE NOT DULY AUTHORIZED TO ENTER INTO SUCH CONTRACT OR IF PROHIBITED BY APPLICABLE LAWS AND REGULATIONS IN YOUR COUNTRY OF RESIDENCE OR IN THE COUNTRY FROM WHICH YOU WISH TO ACCESS THE SERVICE. IT IS YOUR RESPONSIBILITY TO DETERMINE WHETHER THE COUNTRY, STATE, TERRITORY OR LOCATION FROM WHICH YOU ARE ACCESSING THE SERVICE AUTHORIZES, IN WHOLE OR IN PART, YOUR USE OF THE SITE AND ASSOCIATED SERVICES. ANY USE OF THE SITE AND ASSOCIATED SERVICES BY YOU IS AT YOUR OWN RISK. YOU AGREE NOT TO HOLD US LIABLE IF APPLICABLE LAW OR REGULATIONS RESTRICT OR PROHIBIT YOUR USE OF THE SITE AND ASSOCIATED SERVICES IN WHOLE OR IN PART.

2. Duel account (from now on, tournament's "Organizer" or "Administrator")

To access the features of the Internet Website and use the associated Services, you must create a Duel account. When you create your Duel account, you must provide information that you represent to be complete and accurate. You can modify the personal data you provide when creating your Duel account at any time. We take reasonable IT measures to ensure the security of your Duel account, but it is your responsibility to take all necessary precautions to ensure the security and confidentiality of your Duel account and, in particular, to choose a strong password. We give you the freedom to enter the password of your choice, but we strongly recommend that you choose a password of at least 8 characters and that you don't use the same password for the email address associated with your Duel account. If you notice a security breach in your Duel account, please contact us immediately at [email protected] .com. Your Duel account is created without a time limit. You can access your account at any time by entering your username and the associated password you have selected. If you fail to comply with your obligations under the Terms, we reserve the right to suspend, temporarily or permanently, your access to your Duel account without prejudice to any other rights we may have.

3. Access to Services

The Website and the associated Services are, in principle, available continuously, except in the event of interruption, whether planned or unplanned, for maintenance purposes, or in the event of interruption due to force majeure. We cannot be held responsible for any damage, interruption, total or partial, of any kind, resulting from the lack of availability of the Website and the associated Services.

4. Content

By using the Service and as a Duel account holder, you may display, produce, perform, publish Content. “Content” means all information displayed, produced, represented, published, such as text, messages, images, logos, illustrations, videos, information about Participants, results and associated hypertext links. You are solely responsible for the Content that you distribute when using the Service. Once you make your Content accessible to the public, you agree that Duel, and any other Internet user, has the right to access, share and redistribute the Content on any platform and through all communication channels, in particular through Internet and social networks, and this in a royalty-free, non-exclusive and without time limit. You represent that the information you post is complete, accurate and free of intentional or malicious errors, such as false results.

5. Warranties and limitation of liability

  • 5.1. Website and Services Availability

    Duel is subject to an obligation of diligence in the access and availability of the Website and the Services, and cannot be held responsible in the event of damages, of any nature, in the event of unavailability of the Website. You are hereby informed that the Website and the Services may be temporarily unavailable for reasons of maintenance, service, updating of the Services or for reasons beyond our control.

  • 5.2. Warnings

    YOU ACKNOWLEDGE THAT THE USE OF THE WEBSITE AND ASSOCIATED SERVICES ARE PROVIDED 'AS IS' WITHOUT WARRANTY OF ANY KIND, AND THAT YOU USE SUCH WEBSITE AND SERVICES AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR THE CONTENT, RELIABILITY OR AVAILABILITY OF THE SERVICES AND, TO THE LIMITS PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES. YOU EXPRESSLY ACKNOWLEDGE THAT OUR SERVICES ARE LIMITED TO A DUTY OF CARE.

  • 5.3. Provider of content hosting services

    As an Internet hosting service provider, Duel is not responsible for the Content made available on the Website by Internet users, in particular with regard to the description of a Tournament. Duel declines all responsibility for the conditions of participation established through the Service and agreed upon by a Participant and a Tournament Organizer.

  • 5.4. Disputes between users

    Only the Tournament Organizer will be fully responsible in the event of a dispute between a Participant. Duel declines all responsibility in the event of any dispute arising during a Tournament and will instruct the Participant to contact the designated Organiser.

6. Personal information

  • 6.1. Generality

    When you use the Services, we may collect and process your personal data. In addition, you may also share your personal data with other users of the Services and, in particular, with tournament organizers or participants. We invite you to be particularly attentive to the personal data you provide when using the Services and never disclose sensitive or risky information (such as political opinion, religious opinion, passport number, bank card number). For more information about the collection, processing of your personal data and your rights, please read our Privacy Policy.

  • 6.2.1. General information about the collection of your personal data by the tournament organizers

    The available Services on Duel allow tournament organizers to collect and process the personal data of participants who registered for their tournament. Tournament organizers are responsible for the processing of personal data collected for their tournament. As a tournament organizer, you can choose to define the purposes and means of processing implemented for the conduct of your tournament, in accordance with the Duel Privacy Policy and the European General Data Protection Regulation of April 27, 2016. Duel acts as a data processor on behalf of the tournament organizer who is responsible for any processing carried out. In the event that a tournament organizer collects personal data that does not comply with the provisions of the Duel Privacy Policy or the European General Data Protection Regulation of April 27, 2016, Duel reserves the right to close the organizer's account by written notice unless, within thirty (30) days, the defaulting organizer cures such breach, or immediately in the event of serious or repeated breach of any of said provisions.

  • 6.2.2. Processing and purpose of personal data collected by tournament organizers

    When you organize a tournament, you may ask your participants to provide personal data. You are only authorized to collect participant data that is strictly necessary for the conduct of your tournament and, in particular, to verify that your participants respect the conditions of participation of your tournament. You may ask your participants to send proof that justifies the veracity of their data.

  • 6.2.3. Storage of personal data collected from tournament organizers

    Tournament organizers are not authorized to store personal data for a period of time longer than that specified in Duel's Privacy Policy.

    The tournament organizers undertake to take all appropriate security measures to protect Duel and users or visitors of the Website against any unauthorized access, modification, disclosure or destruction of personal data collected through the Services. The tournament organizers undertake to respect the rights of users in relation to their personal data and, in particular, the rights defined in the Duel Privacy Policy or by any applicable law or regulation.

  • 6.2.4. Abuse and complaints

    If you believe that a tournament organizer is not acting in accordance with the Duel Privacy Policy, you may notify us by email [email protected] .

7. Intellectual property

  • 7.1 The Website, its contents and Services, its software, designs, models, databases, trademarks and logos are protected by intellectual property and copyright law.

    The user agrees to respect these rights. Duel is a registered trademark in the European Union and other territories.. All rights reserved.

  • 7.2 The products and video games presented on the Website correspond to registered trademarks or brands belonging to their respective owners.

If one or more clauses of these Terms are declared null and void pursuant to a law or regulation or by decision of a court of law, the remaining clauses will continue to apply. Any dispute related to the execution of these Terms will be the jurisdiction of the Spanish courts. In the event of a dispute between Duel and a professional user, the courts of Vigo, Spain, will have sole jurisdiction. Within the limits expressly authorized by law, as a non-professional user, you acknowledge that only the courts of Paris will have jurisdiction in the event of any dispute that may arise between you and us.
