TOURNAMENT – TERMS OF USE

The company Galvin Tecnologica SL (hereinafter, "Duel" or "we"), located at Avda. de Madrid, 197 - 36214, Vigo, Spain; uses the Duel software package (an Internet platform application that can be accessed at the address https://duel.plus, hereinafter, the 'Web') that allows users to create, organize, manage and share tournaments or participate in tournaments (hereinafter, 'Services').
1. Acceptance and modification of the General terms and Conditions of Use
THE GOAL OF THESE TERMS OF USE (hereinafter, the "Terms"), WHICH ARE SUBJECT TO THE SPANISH LAW, IS to REGULATE THE USE OF the SITE AND THE SERVICES ASSOCIATED with it. YOUR ACCESS TO AND USE OF THE SITE AND THE SERVICES, WHETHER ACTING AS AN INDIVIDUAL OR ON BEHALF OF A COMPANY, CONSTITUTES YOUR EXPRESS ACCEPTANCE AND FULL OF THE TERMS, AND YOU REPRESENT THAT YOU HAVE ALL RIGHTS, AUTHORIZATION AND POWERS NECESSARY TO ACCEPT THE TERMS, TERMS. THE TERMS MAY BE MODIFIED AT ANY TIME WITHOUT PRIOR NOTICE OR RECOGNITION, AND THEREFORE IT IS YOUR RESPONSIBILITY TO CHECK THEM PERIODICALLY. IT IS YOUR RESPONSIBILITY TO DETERMINE IF THE COUNTRY, STATE, TERRITORY OR PLACE FROM WHERE YOU ARE ACCESSING THE SERVICE AUTHORIZES, IN WHOLE OR IN PART, THE USE OF THE SITE AND THE SERVICES ASSOCIATED WITH IT. ANY USE THAT YOU MAKE OF THE WEBSITE AND THE ASSOCIATED SERVICES IS AT YOUR OWN RISK. YOU AGREE NOT TO HOLD US RESPONSIBLE IF THE LAW OR APPLICABLE REGULATIONS RESTRICT OR PROHIBIT THE USE OF THE WEBSITE AND THE ASSOCIATED SERVICES, IN WHOLE OR IN PART.
2. Account Duel (hereinafter, the ‘Organizer’ or ‘Administrator’ of the tournament)
To access the features of the Web of the Internet and use the associated Services, you must create an account in Duel. When you create your account Duel, you must provide information that is declared to be complete and accurate. You can modify the personal data transmitted to the create your account Duel at any time. We take it measures reasonably calculated to ensure the security of your account Duel, but it is your responsibility to take all necessary precautions to ensure the security and confidentiality of your account Duel and, in particular, choose a secure password. We give you the freedom you enter the password of your choice, but we strongly recommend that you choose a password of at least 8 characters long and does not use the same password for the email address associated with your account Duel. By using the Service, and as a holder of an account of the Duel, you can display, produce, perform, publish Content. “Content” means all information that is shown, produces, represents, publishes, such as text, messages, images, logos, illustrations, videos, info about the Participants, results and hypertext links associated with it. You are solely responsible for the Content that it distributes the use of the Service. Once it makes its Content is accessible to the public, you agree that Duel, and any other Internet user, you have the right to access, share and distribute Content to any platform and through all channels of communication, in particular via the Internet and social networks, and this the royalty-free, non-exclusive and no time limit. You declare that the information that you publish is complete, accurate, and does not contain errors, intentional or malicious, as false results.
5. Warranties and Limitation of Liability
5.1. Availability of the Website and the Services
Duel is subject to an obligation of diligence in the access and availability of the Website and the Services, and may not be held liable in case of damage, of any nature whatsoever, in case of unavailability of the Web. For the present, informs you that the Website and the Services may not be available temporarily for reasons of maintenance, service, update the Services, or for reasons that are beyond our control.
5.2. Warnings
YOU ACKNOWLEDGE THAT the USE OF THE Website AND THE SERVICES ASSOCIATED with it ARE PROVIDED ‘AS is’ WITHOUT WARRANTY OF ANY KIND, AND THAT you USE the Website AND SERVICES at YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR THE CONTENT, RELIABILITY OR AVAILABILITY OF THE SERVICES AND, WITHIN THE LIMITS AUTHORIZED BY LAW, WE EXCLUDE ALL WARRANTIES. YOU EXPRESSLY ACKNOWLEDGE THAT OUR SERVICES ARE LIMITED TO AN OBLIGATION OF DILIGENCE.
5.3. Hoster content
As a provider of accommodation services of the Internet, Duel is not responsible for the Content made available on the Web for Internet users, in particular in what concerns the description of a Tournament. Duel disclaims any and all liability for the conditions of participation established through the Service and agreed to by a Participant and an Organizer of the Tournament.
5.4. Disputes between users
Only the Organizer of the Tournament will be held fully responsible in the event of a dispute between a Participant. Duel declines all responsibility in case of dispute during a Tournament, and indicate to the Participant that is put in contact with the designated Organiser.
6. Personal data
6.1. Generality
When you use the Services, we may collect and process your personal data. In addition, you may also share your personal data with other users of the Services and, in particular, with the organizers or participants of tournaments. We invite you to be especially attentive to the personal data you provide when you use the Services and never disclose sensitive information or that is risky (such as political opinion, religious opinion, passport number, credit card number). 6.2.1. General information about the collection of your personal data on the part of the organizers of the tournament
The Services available in Duel allows tournament organizers to collect and process the personal data of the participants who registered in your tournament. The tournament organizers are responsible for the processing of the personal data collected for their tournament. As the organizer of a tournament, you can choose to define the purposes and means of processing implemented for the completion of your tournament, in accordance with the Privacy Policy of the Duel, and with the General Regulations of the European Data Protection of 27 April 2016. Duel acts as data processor on behalf of the organizer of the tournament which is responsible of any processing carried out. In the event that the organizer of a tournament to collect personal data that do not comply with the provisions of the Privacy Policy of Duel or with the General Regulations of the European Data Protection of 27 April 2016, Duel reserves the right to close the account of the organizer by written notice unless, within thirty (30) days, the organizer offender to cure such breach, or immediately in the event of serious or repeated breach of any of such provisions.
6.2.2. Processing and purpose of the personal data collected by the organizers of the tournament
When he organizes a tournament, you may ask your participants to provide personal data. You are only authorized to collect the data from the participants that are strictly necessary for the realization of your tournament and, in particular, to verify that your participants respect the conditions for the participation of your tournament. You can request your participants sending you a proof to justify the accuracy of their data.
6.2.3. Storage of personal data collected by the organizers of the tournament.
The organizers of the tournament are not permitted to store personal data for a longer period of time than specified in the Privacy Policy of Duel.
The organizers of the tournament are committed to taking all appropriate security measures to protect Duel and the users or visitors of the Web against any access, modification, disclosure, or destruction, unauthorized of the collected personal data through the Services. The organizers of the tournament are committed to uphold the rights of users in relation to your personal data and, in particular, the rights defined in the privacy Policy of Duel or by any applicable law or regulation.
6.2.4. Abuse and complaints
If you think that the organizer of the tournament is not acting in accordance to this Privacy Policy, you may notify us by e-mail hello@duel.plus .
7. Intellectual Property
7.1 The Website, its contents and Services, your software, designs, models, databases, trademarks and logos are protected by the law of intellectual property and author rights.
The user undertakes to respect these rights. Duel is a registered trademark in the European Union and other territories. All rights reserved.
7.2 The products and games presented on the Website correspond to trademarks or brands belong to their respective owners.
If one or more provisions of these Terms be declared void and of no effect in accordance with a law or regulation, or by decision of a court, the remaining provisions shall continue to be applicable. Any dispute in connection with the execution of these Terms shall be jurisdiction of the Spanish courts. In the event of a dispute between Duel and a professional user, the courts of Vigo, Spain, will be the only ones competent. Within the limits expressly authorized by law, as a non-professional user, you acknowledge that only the courts of Paris will be competent in the case of dispute that might arise between you and us.
